Personal Injury

Personal Injury is when a physical injury is inflicted on a person's body, as opposed to damages being forced on a person's property or reputation. Bankruptcy

  • With a Chapter 7 Bankruptcy, debts are eliminated (with some exceptions). This type of bankruptcy is chosen by people who have severe credit problems, repossessions, foreclosures and judgments. The debtor does not have a payment plan for creditors, and basically has an opportunity to completely start over and rebuild good credit.
  • With a Chapter 13 Bankruptcy, a payment plan is arranged with creditors on terms that are advantageous to the debtor. This type of bankruptcy is for debtors who have the income to fund a repayment plan and allows them to keep property on which they owe back-payments.
  • Debt Settlement is an alternative to Bankruptcy. We are licensed in the Texas Western District and can file your case if you have lived in one of the following counties for the previous 90 days: Travis, Bell, Williamson.

The Texas Property Code provides certain exemptions for individuals and married couples that will allow the debtor to keep certain property. You need an experienced Bankruptcy expert to know what assets you have that may be exempt. You will also need an attorney to determine if you pass the income based "means test" to qualify for a Chapter 7 or a Chapter 13 case. Our Firm can guide you through this process

Legal Malpractice

Legal malpractice claims arise when a lawyer fails to exercise ordinary care in the representation of a client. Drunk Driving Victims

In 2010, 10,228 people were killed in alcohol-impaired driving crashes, accounting for nearly one-third (31%) of all traffic-related deaths in the United States according to the Department of Transportation. Car accidents can have a serious effect on you and your family's lives. An injured victim may accrue medical expenses, mental anguish, lost wages, and pain and suffering resulting from someone who was negligent in driving a vehicle. Often, insurance adjusters will attempt to settle these cases quickly before you can get an attorney involved in your case, knowing that the attorney will be able to seek punitive damages against the defendant, and maximize potential recovery. Minor Children in Car Accidents

Under Texas Law, children under the age of 18 may not contract with a lawyer. In the event a child is injured in a car accident, a parent should seek to retain the advice of an attorney. The attorney may file suit on behalf of the parent(s) as next of friend against a responsible party. Complications may arise later that were unforeseen, or the child may not have shown any signs of an injury following the accident. It is important to timely retain an attorney in these types of cases and pursue a responsible party prior to the running of two year statute of limitations to bring a claim on behalf of a minor.

Trucking Accidents

Texas Department of Transportation has restricted trucks from driving in the left lane for more than 400 miles of highway in 14 counties. Unfortunately, there are still accidents that occur and require the right legal representation. 18 Wheelers and large commercial vehicles are inherently more dangerous and will cause more serious injuries in the event of a collision with smaller passenger vehicles. Truck drivers have tight schedule deadlines which may cause a truck driver to drive more aggressively or drive impaired from a lack of sleep. Other times, a truck driver may fail to check its blind spots, drive under the influence, ignore signage, or just flat out violate a safety rule. The Act is a set of statutes that determine when a governmental entity may be liable for tortuous conduct under state law. Premises Liability Cases

Falls are one of the leading causes of unintentional injuries in the United States, accounting for approximately 8.9 million visits to the emergency department annually (NSC Injury Facts 2011). These cases can involve wet floors, gaps in concrete, or any other dangerous condition that may exists on a premises caused by the negligence of a property owner, landlord, security company or maintenance company. Nursing Home Abuse/Negligence

The study, prepared by the minority (Democratic and Independent) staff of the Special Investigations Division of the House Government Reform Committee, finds that 30 percent of nursing homes in the United States — 5,283 facilities — were cited for almost 9,000 instances of abuse over a recent two-year period, from January 1999 to January 2001. Under Qui Tam laws under the Texas Medicaid Fraud Prevention Act, a whistleblower can bring a claim and may recover in damages in a fraud case.
